Terms of Service

1. Your agreement

These Terms of Service ("Terms") are a binding agreement between you and the developer of CNTR ("we", "us") and govern your use of the CNTR mobile application and related services (the "Service"). By downloading or using CNTR, you agree to these Terms and our Privacy Policy.

2. Eligibility

You must be at least 13 years old (16 in the EEA) to use CNTR. By using the Service you represent that you meet this requirement.

3. License

We grant you a personal, revocable, non-exclusive, non-transferable, non-sublicensable license to download and use CNTR on devices you own or control, solely for your personal, non-commercial use.

4. Acceptable use

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code from the App.
• Use the Service to violate any law or third party's rights.
• Attempt to interfere with, disrupt, or overload the Service.
• Use the Service to log content that is illegal, abusive, or designed to manipulate the AI parser.
• Resell, sublicense, or commercially exploit the Service.

5. Your content

You retain ownership of the workout text you submit. You grant us a worldwide, royalty-free license to host, store, and process that text solely to operate, secure, and improve the Service. We will not use your content for advertising or sell it to third parties.

6. Health & fitness disclaimer

CNTR is a workout-logging tool. It is not a medical device, personal trainer, physical therapist, nutritionist, or substitute for any of those. Nothing the App produces — including AI responses, exercise classifications, recalled equipment settings, or progress charts — constitutes medical, physical-therapy, fitness, or nutritional advice.

Consult a qualified healthcare professional before starting any new exercise program, changing your training, or acting on anything you see in CNTR. This applies especially if you are pregnant, have a heart condition, high or low blood pressure, diabetes, asthma, a recent injury, or any condition that could be affected by exercise. Stop training and seek medical attention immediately if you experience pain, dizziness, shortness of breath, chest discomfort, or any unusual symptoms.

Strength training carries inherent risk of injury, including serious injury and death. You are solely responsible for your form, the weight you load, your warm-up, your safety equipment, and using a spotter when appropriate. By using CNTR you knowingly and voluntarily assume all risk associated with your training.

7. AI features & accuracy

CNTR uses third-party AI models to interpret natural-language input, classify exercises, ask follow-up questions, and recall information you previously logged. AI output is best-effort and probabilistic — it may be incomplete, inaccurate, or wrong. In particular:

• The AI may misclassify the exercise you described.
• The AI may misread weights, reps, or set counts in your input.
• When the AI "recalls" past workouts or equipment settings (for example, "last time you used 120 lbs"), the response is generated from your logged data and may be inaccurate, out of date, or fabricated.
• The AI does not know your fitness level, injuries, medical history, or limits.

Always verify what was logged before relying on it. Do not load weight, change form, or make training decisions purely on the basis of an AI response without checking the underlying log and using your own judgment. If a recalled value looks wrong, treat it as wrong.

8. Availability & changes

CNTR is in active, ongoing development. Any aspect of the Service — including features, behavior, AI models, design, data formats, limits, and these Terms — may change, be added, be removed, or be discontinued at any time and without prior notice. We will provide reasonable advance notice of material changes that adversely affect existing users where practical, but you should not rely on any current feature, behavior, or output remaining available or unchanged.

9. Fees & subscriptions

The core Service is currently free. We reserve the right to introduce paid features, subscriptions, usage limits, or to transition the Service (in whole or in part) to a paid model at any time. We will notify users in advance before any feature you currently use without charge becomes paid, and you will have the opportunity to decline and stop using that feature. Optional premium features may be offered as in-app purchases through the Apple App Store, governed by Apple's standard purchase terms. Refunds for App Store purchases are handled by Apple.

10. Termination

You may stop using the Service at any time by uninstalling the App. We may suspend or terminate your access if you materially breach these Terms. Sections that by their nature should survive termination will do so.

11. Warranty disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or that AI output will be correct, complete, or reliable. We do not warrant that the Service will be uninterrupted or error-free.

12. Limitation of liability

To the maximum extent permitted by law, CNTR and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or training outcomes — including any injury or harm resulting from your training, your reliance on AI output, or any inaccuracy in recalled or classified data. Our aggregate liability for direct damages will not exceed the greater of (a) US$50, or (b) amounts you paid us for the Service in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless CNTR, its developer, and its contractors from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) any injury or harm resulting from your training or your reliance on AI output.

14. App Store (Apple)

If you obtained CNTR through the Apple App Store, the following also applies:

• These Terms are between you and the developer of CNTR, not Apple. Apple is not responsible for the App or its content.
• The license in Section 3 is limited to use on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
• The developer of CNTR, not Apple, is responsible for addressing any product or third-party intellectual property claims relating to the App.
• You represent that you are not located in a country subject to a U.S. Government embargo and not on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Disputes will be resolved in the state or federal courts located in Delaware, except where applicable consumer law provides otherwise.

16. Other terms

If any provision of these Terms is found unenforceable, the rest stays in force. Our failure to enforce a right is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. We may update these Terms from time to time; material changes will be posted here with an updated date, and continued use after the change constitutes acceptance.
